More Alleged Breaches of Awards.

The Arbitration Court resumed the hearing of cases for alleged breaches of awards under the Industrial Act this morning.
All About Boys.
The first taken was that of the Wellington Butchers' Union against A. G. Haines. The allegation of the union (for which Mr. Dunne appeared) was that Mr. Haines had committed a breach of the award of the Arbitration Court by taking into his employ one boy more than the Act permitted. It was further alleged that the boy so employed was a nonunionist.
Mr. Gray appeared for the defendant, who in his evidence said that he had never been approached properly by the union in reference to the employment of the boy. The boy was in his employ prior to the making of the award, and when it was declared he discharged him. The boy was out of work for some four weeks after that and then witness took him on as a casual hand. Witness said he had applied to the union asking to be allowed to take on a boy, but it had refused. Witness made this application because he wanted to work on union lines.
Mr. Justice Cooper — The contention of the union is that witness was not entitled to take on another boy.
Mr. Dunne — That is so.
In further evidence the witness said he was not thoroughly conversant with the requirements of the Act or the conditions of the award.
F. R. Bust, formerly secretary of the union, deposed as to having advertised alterations in the rules of the union in consequence of the award. The union kept a register of the names of men open for employment and the defendant Haines or any other employers could inspect such register.
William Henry Mayher, aged 19, deposed as to having been employed by the defendant Haines, who also had in his employ at the time two sons, one of whom was under 21 years of age. Witness was "sacked" about the time the award was made, because, Mr. Haines said, the union would not allow him to keep him on. Some time afterwards Mr. Haines took witness on again, but only to assist on Saturdays.
This was the case for the union.
Mr. A. Gray submitted that the case was of so trivial a nature that it ought not to be allowed to occupy the time of the Court. The admitted fact was that at the time of the award the defendant had the boy in his employ, but said that as soon as the union notified that he was not observing the provisions of the award defendant discharged the lad. The casual work given to the boy afterwards was not such as could justify the present action.
The Court deferred giving its decision, but the President intimated that in this case it would not take into consideration the allegation of employing a non-unionist.
