On 7th December 1799, Jacob aged 36 a private in the Somerset Militia married Martha Everton (baptised on 26 May 1781 at St. Peters, Tiverton), aged 21 at St Peters, Tiverton.
Soon after his marriage Jacob transferred from the Somerset Militia to the 40th Foot and on 28th March 1800 the regiment went to Minorca. On the 24th February 1802 Jacob transferred from the 40th Regiment to the 17th 1st Battalion (the Leicestershire Regiment).

Martha Pye could have marched behind the Army from the time of her marriage in December 1799 until Jacob's departure to India in July 1804. There is no sign of her in Devon or Somerset until James is Baptised at Tiverton in October 1804, and this is nearly five months after he was born. The Regiment embarked on the 7th May 1804 for Newport, Isle of Wight, either James was born on board a ship or in Newport on the Isle of Wight.

Martha Pye. Widow. Born in Tiverton where her parents belonged, married there about 16 years ago to Jacob Pye, a militia man who went abroad on His Majesty's service and died in the East Indies about 8 years ago, she married again James Hardy in Salisbury. She does not know where he is settled, at the time of the marriage he was a married man, she received a letter from his first wife. Her first husband came from Combe Hay, Somerset, she had one child by him James aged 10 and two by her second husband, Rhoda aged 7 and Peter aged 18 months.
