Collision Litigation.
The afternoon sitting of the Magistrate's Court yesterday was taken up with the hearing of a claim for damages resulting from a collision on the Hutt road on 5th May. Daniel Anderson, motor-car driver, claimed from William Haines, jun., butcher, the sum of 44 pounds 11 shillings. He stated that he was driving his car along the Hutt road towards Petone about midnight on 5th May. He was on the correct side of the road, and his four lamps were alight. About a mile past Kaiwarra (sic) a horse and cart suddenly burst out of the darkness and collided with his car. Defendant, who entered a counter-claim for 4 pounds 15 shillings for loss of twenty fowls and damage to his cart and lamps, alleged that the accident was caused through the negligence and unskillful driving of the plaintiff. The further hearing of the case was adjourned till Thursday. Mr. H. F. O'Leary appeared for plaintiff and Mr. C. W. Nielsen for the defendant.

The Evening Post 22nd July 1915 shows
A collision on the Hutt road between a motor-car and horse and cart formed the subject of an action, which was partly heard in the Magistrate's Court on Tuesday and concluded to-day. Daniel Anderson, the plaintiff, claimed the sum of 44 pounds 11 shillings for damage caused to his motor-car through the unskillful and negligent driving of William Haines, jun., butcher, who was driving a horse and cart from Rona Bay to Mitchelltown when the collision occurred. A counter-claim for 4 pounds 15 shillings was put in by the defendant for the loss of twenty fowls and damage to his cart and lamps. In entering judgment for plaintiff for 40 pounds 17 shillings 6 pences and 5 pounds and 4 shillings costs, Mr. D. G. A. Cooper, S.M., said there was a conflict of evidence in all these cases as to who was on the right side of the road, but the weight of evidence was in favour of plaintiff. Mr. H. F. O'Leary appeared for plaintiff and Mr. C. W. Nielsen for defendant.
